MyGuardz Terms of Service

Effective: 10 September 2026

1. INTRODUCTION

Thank you for using MyGuardz.

These Terms of Service ("Terms") form a legally binding agreement governing your access to and use of the MyGuardz mobile application and its application programming interfaces (the "MyGuardz App"), our websites and technology platform (the "MyGuardz Web"), and all associated services (the "MyGuardz Services"). Together these are referred to as the "MyGuardz Platform", or simply "MyGuardz".

These Terms are an agreement between:

Brombul d.o.o., a limited liability company incorporated under the laws of the Republic of Croatia, with its registered office at Rudeška cesta 246, 10000 Zagreb, Croatia, EUID HRSR.081145083, VAT number HR10843547902 (referred to as "we", "us" or "our"),

and you, the person who has created an Account on MyGuardz (referred to as "you", "your" or the "User").

These Terms incorporate our Privacy Policy, available at https://www.myguardz.com/privacy and in the MyGuardz App. Together they are the complete agreement between us.

By creating an Account and using MyGuardz, you confirm that you have read, understood and agree to these Terms. If you do not agree with them, please do not use MyGuardz.

The current version of these Terms is always available at https://www.myguardz.com/terms-of-service and inside the MyGuardz App. If you would like anything explained, contact us at team@myguardz.com.

Please read Section 3 carefully. It sets out what MyGuardz is, and - just as importantly - what it is not. Nothing in MyGuardz replaces the emergency services.

2. DEFINITIONS

"Account" means your personal profile on the MyGuardz Platform, created when you register in the MyGuardz App and accept these Terms.

"Alarm" means an alert raised through the MyGuardz Platform which opens an Alarm Chat and notifies your Circle and, where applicable, your Household. An Alarm may be raised by you manually, automatically by the expiry of a Stay With Me Timer, by a Household member, or by a Connected Device.

"Alarm Chat" means the shared conversation opened by an Alarm, in which you, your Circle and (for a Home Alarm) your Household can exchange messages and images and can see (where enabled and applicable) your Live Location.

"Call-Out" means a Guard physically travelling to your Live Location or to a Home. The Control Room contacting you is a Response, not an Call-Out.

"Circle" means the people you have invited, and who have accepted, to be notified and to join your Alarm Chat when an Alarm is raised. Circle members act voluntarily and free of charge.

"Connected Device" means a smart-home sensor, camera, personal emergency response system, voice assistant, automation platform or any other device or service you have connected to MyGuardz, from which a notification you have configured can raise an Alarm.

"Control Room" means the alarm receiving centre operated by a Response Partner, which handles an Alarm forwarded under Guard Cover.

"Guard" means a security officer employed or engaged by a Response Partner and licensed in the jurisdiction in which they operate.

"Guard Cover" means the optional, paid service we sell under which an Alarm is forwarded to a Response Partner's Control Room, which may then dispatch a Guard. Guard Cover can be switched on for a single trip, for a Home, or for a Home you Support. Bought for a trip, it covers that trip. Bought for a Home, it covers that Home for the period shown in the MyGuardz App. It is not a subscription and it does not renew. It is a one-off purchase. It is not a subscription and it does not renew automatically.

"Home" means an address you have entered into MyGuardz under your Account. A Home does not have to be a place you live.

"Household" means you and the people you have added to a specific Home. Household members can raise an Alarm for that Home and, where location sharing is enabled, can see a Presence Indicator for other Household members.

"Live Location" means the location of your device, updated continuously, shared only while an Alarm is running, as described in Section 3.4 and in the Privacy Policy.

"Presence Indicator" means the home/away icon shown to your Household. It shows only whether you are at a Home, never where you are.

"Response" means everything the Response Partner does after an Alarm is forwarded under Guard Cover: it begins with the Control Room attempting to contact you, and it includes a Call-Out where one is made.

"Response Partner" means the independent, licensed third-party security company we have engaged to provide Control Room handling and Guard dispatch in a given area. The Response Partner covering your area is identified in the MyGuardz App before you purchase Guard Cover.

"Service Terms" means the Response Partner's own terms, which set out how that Response Partner performs a Response and what conditions apply to an Call-Out. They are shown to you in the MyGuardz App before you first switch Guard Cover on in an area. Your contract for Guard Cover is with us (see Section 9.4), and where the Service Terms conflict with these Terms, these Terms govern your contract with us.

"Stay With Me Timer" or "Timer" means the countdown you set before or during an activity, at the end of which you are expected to check in. If you do not check in, an Alarm is raised.

"Supporting" means being a member of another User's Circle, or being connected to another User's Home in order to receive their Alarms.

"User Content" means any message, image, name, address, note or other material you submit to MyGuardz.

3. WHAT MYGUARDZ IS - AND WHAT IT IS NOT

3.1 What MyGuardz is

MyGuardz is a technology platform. It does two things:

1.  It lets you arrange, in advance, for people you choose to be told and brought into a conversation if something appears to have gone wrong - either because you did not check in against a Timer, or because you or a Household member or a Connected Device raised an Alarm.

2.  Where you have bought Guard Cover and a Response Partner covers your area, it forwards that Alarm to that Response Partner's Control Room.

3.2 What MyGuardz is not

MyGuardz is not an emergency service. It does not replace the police, ambulance, fire service or any other emergency service. If you are in danger or need urgent help, contact the emergency services directly.

We are not a security company. We do not employ Guards, we do not operate a Control Room, and we do not provide security services. Guards and Control Rooms are provided by independent, licensed Response Partners.

We do not monitor your Alarms. Unless Guard Cover is switched on for the relevant Timer or Home, an Alarm goes only to the people you have chosen. Nobody at MyGuardz watches it, and nobody is on duty to act on it.

We do not guarantee that anyone will respond. Your Circle are volunteers. They may be asleep, out of signal, unavailable, or simply may not act. Section 5 explains this in full.

Guard Cover is a deterrent, not a preventative measure. It is not an insurance policy and it does not replace one, or any other protective measure you would otherwise take.

MyGuardz is not a medical, health or care service, and must not be relied on as one.

3.3 MyGuardz depends on things outside our control

MyGuardz can only work if, at the relevant moment:

  • your device is switched on and has sufficient battery;

  • your device has a working mobile data or internet connection;

  • location and notification permissions are granted at the level the feature requires;

  • the operating system has not suspended or restricted the MyGuardz App in the background;

  • the recipients' devices are on, connected and able to receive notifications; and

  • for Guard Cover, a Response Partner is operating in that area at that time and has capacity.

Any of these can fail, and some of them are controlled by your device manufacturer, your operating system or your network operator rather than by us.

3.4 The three levels of location sharing

MyGuardz deliberately treats three different kinds of location data differently:

Presence Indicator - whether you are at a Home, is shared with Your Household whenever you have enabled location sharing. Your status updates as you come and go, and you can switch it off at any time.

Live Location - where you are, is shared with Your Circle, only once an Alarm is raised. Setting a Timer does not share your location; sharing begins with the Alarm and ends when the Alarm is closed.

Live Location - where you are, is shared with Response Partner only when that Alarm is forwarded under Guard Cover, and only for as long as the response takes.

Full detail is in the Privacy Policy.

4. ELIGIBILITY, ACCOUNTS AND VERIFICATION

4.1 Creating an Account
To use MyGuardz you need an internet connection, a compatible mobile device, and an Account. To register we ask for your name, mobile number capable of receiving SMS, email address and your age.
You agree that the information you give us is true, accurate and current, and that you will keep it up to date. An out-of-date phone number or email address may prevent us or your Circle from reaching you.

4.2 Age
You must be at least 18 to hold an Account, to be a member of another User's Circle, to Support another person or Home, or to purchase Guard Cover.
A person under 18 may be added to a Household by an adult User, but only where that adult User is the child's parent or legal guardian, or has obtained the verifiable consent of the child's parent or legal guardian. By adding a person under 18 to your Household you confirm that you have that authority, and you remain responsible for their use of MyGuardz. Only you, the adult User, have a contractual relationship with us.
If we become aware that we hold data about a child without valid consent, we will delete it.

4.3 Keeping your Account secure
You choose a passcode when you register. You must keep it confidential, must not share your Account, and must not let anyone else use it. You are responsible for everything that happens through your Account, including purchases, whether or not you initiated it.
If you believe your Account has been compromised, change your credentials immediately and tell us at team@myguardz.com.

4.4 Personal and non-commercial use
MyGuardz is provided for your personal, non-commercial use. You may not resell, sub-license, deep-link into, scrape, copy, monitor, reproduce or exploit any part of the MyGuardz Platform for a commercial or competitive purpose.

5. YOUR CIRCLE, AND SUPPORTING OTHERS

5.1 Inviting your Circle
You choose who is in your Circle. When you invite someone, they must accept before they receive anything. When they accept, your name and mobile number become visible to them, and theirs to you, so that you both know who you are relying on.
You must have that person's permission before you add them. By inviting someone you confirm that you are entitled to give us their contact details for this purpose.

5.2 Circle members are volunteers
Members of your Circle act voluntarily and free of charge. They are not our employees, agents or contractors, we do not vet, train, supervise or insure them, and we do not check their conduct, reputation or background.
No member of your Circle owes you any duty to respond. Nothing in these Terms creates such a duty, and nothing in MyGuardz should lead you to rely on one.

5.3 Availability
Circle members can set the hours in which they are available to help. Outside those hours they may not be notified. This is a convenience feature and it is not a rota: someone shown as available may still be unable or unwilling to respond.

5.4 Seeing who joined
The Alarm Chat shows which members of your Circle have joined it. This tells you that a notification was opened. It does not tell you that anyone is coming, and it is not a commitment by them to do anything.

5.5 Supporting other people
If you join someone else's Circle:

  • You do so voluntarily. You may leave at any time.

  • You must not charge for your help, and you must not represent yourself as a security professional.

  • You are not a vigilante. If you believe someone is in danger, contact the emergency services. Do not intervene in a situation that is unsafe.

  • You will receive that person's Live Location during an Alarm. You must use it only to help them, must not record, store, publish or pass it on, and must stop using it when the Alarm ends.

Misuse of another User's location is a serious breach of these Terms and may also be a criminal offence.

5.6 Alarms you did not intend to raise
Because a Timer raises an Alarm automatically when it expires, and because the Timer runs on our servers rather than on your phone, an Alarm can occur when nothing is wrong - for example if your phone loses power or signal before you check in, or if you simply forget.
Setting a Timer for longer than you think you need is safer than setting one too short. A Timer that expires while your phone is off will raise a real Alarm, and where Guard Cover is active it may result in a real Call-Out and, where an Call-Out is chargeable, a real charge (see §10.5).
You accept that this will sometimes happen and that your Circle may be alarmed unnecessarily.

6. HOMES, HOUSEHOLDS AND CONNECTED DEVICES

6.1 Adding a Home

You may add one or more Homes. You must give an accurate address: it determines whether Guard Cover is available and, if a Guard is dispatched, where they are sent. An inaccurate address may send a Guard to the wrong place, and you are responsible for that.

You must be entitled to enter that address into MyGuardz and to invite a response to it.

6.2 Household

Household members can raise an Alarm for that Home. Where location sharing is enabled, they can see each other's Presence Indicator - home or away, never a location.

You must have each Household member's permission before adding them, and you must tell them what they will be able to see and what will be visible about them. If a Household member withdraws consent, remove them.

6.3 Connected Devices and webhooks

You may connect a sensor, camera or automation platform so that a notification you configure raises an Alarm.

  • You configure it, and you are responsible for it. We do not control the device, its rules, its reliability or its false-alarm rate.

  • We are not responsible for any third-party platform, its availability, or any change it makes to its interfaces.

  • An Alarm raised by a Connected Device is treated exactly like one you raised yourself, including under Guard Cover - and is chargeable on the same basis.

  • You must secure the webhook credentials we issue you. Anyone holding them can raise an Alarm on your Home.

7. THE STAY WITH ME TIMER AND ALARMS

7.1 Setting a Timer

You set how long you expect to be. Before the Timer expires we send you a reminder. You can extend it or check in at any time.If your device is off, out of signal or unable to receive notifications, you will not see that reminder - and the Timer will still expire.

7.2 Checking in

Checking in ends the Timer and, where notifications are enabled, tells your Circle you are safe.

7.3 If you do not check in

If the Timer expires without a check-in, an Alarm is raised automatically: an Alarm Chat opens, your Circle is notified and given your Live Location, and if Guard Cover is active for that trip the Alarm is forwarded to the Response Partner's Control Room.

7.4 Timer limits

A Timer can be set for up to the maximum shown in the MyGuardz App. You can extend a running Timer at any time, up to that same maximum. If you need longer, check in and start a new Timer..

7.5 How the Timer runs

The Timer runs on our servers, not on your phone. Once a Timer is set, it will expire and raise an Alarm at the scheduled moment whether or not your device is switched on, in signal, in flight mode, out of battery, or has the App force-quit. A dead or unreachable phone does not stop an Alarm - it is exactly the situation the Timer exists for.

What your device is still needed for: checking in, extending a Timer, closing an Alarm, sharing your Live Location, and receiving the reminder we send before expiry. If your device cannot reach us, you cannot check in - and the Alarm will be raised.

What we still cannot guarantee: that the people you have chosen receive or act on the notification, that their devices are on and connected, or that a Response Partner is available. Sections 3.3, 5 and 9.3 explain this.

7.6 Closing an Alarm

Close the Alarm as soon as the situation is resolved. Leaving an Alarm open keeps your Live Location shared and may result in an unnecessary Call-Out.

8. ACCEPTABLE USE

Violations may result in removal of content, a warning, or temporary or permanent deactivation of your Account.

8.1 Conduct

  • Do not raise false Alarms. Deliberately raising an Alarm when there is no cause wastes your Circle's time and may waste a Guard's, and may be an offence.

  • Do not misuse another person's location. Do not record it, publish it, share it outside the Alarm Chat, or use it to follow, monitor or contact someone.

  • Do not use MyGuardz to track anybody. MyGuardz is built for people who choose to share with people they choose. Coercing someone into a Household or a Circle to keep watch on them is a serious breach of these Terms, and we will act on reports of it.

  • Do not intimidate, stalk or harass any other User.

  • Be yourself. Do not impersonate anyone.

  • Keep it legal.

  • Do not charge for helping as a member of someone's Circle.

  • Do not spam.

8.2 Content

The following User Content is prohibited: hate speech and abusive or inflammatory material; sexually explicit or obscene material, and anything that exploits a minor; personal information about a third party who has not consented to you sharing it; unlawful or infringing material; content glorifying or inciting violence; and unsolicited commercial or political material.

8.3 Reporting

If you believe another User is breaching these rules, tell us at team@myguardz.com. Reports concerning an immediate risk to someone's safety should go to the emergency services first.

9. GUARD COVER AND THE RESPONSE PARTNERS

9.1 What Guard Cover is

Guard Cover is an optional, paid service. It is provided by MyGuardz, and the response itself is carried out by an independent, licensed Response Partner - the Control Room work and any Call-Out are carried out by them, not by us. Section 9.4 explains what that means for your contract.

When you switch Guard Cover on for a Timer or a Home, it opens an alarm monitoring link between MyGuardz and the Control Room of the Response Partner covering that area, and keeps it open for as long as the cover is active. That link is what you are paying for, whether or not an Alarm is ever raised.

If an Alarm is raised for that Timer or that Home while Guard Cover is active, it is forwarded to that Control Room. An Alarm raised when Guard Cover is not active goes only to your Circle and your Household.

9.2 What happens on an Alarm under Guard Cover

  1. The Alarm is forwarded to the Control Room.

  2. The Control Room attempts to contact you first. If you confirm that you are safe, the Response is stood down and no Call-Out is made.

  3. If they cannot reach you, or you confirm you need help, the Response Partner may make a Call-Out - dispatching the nearest available Guard to your Live Location or to a Home.

  4. You can follow the Response in the Alarm Chat.

  5. When you close the Alarm, the Response ends. For a trip, closing it also resolves the trip - see §7.6.

9.3 What we do not promise

  • We do not promise a response time. Response depends on distance, traffic, capacity and the circumstances of the incident, and no time is stated or implied anywhere in MyGuardz.

  • We do not promise that a Guard will be dispatched. That decision is made by the Response Partner's Control Room in its professional judgement, on the information available at the time.

  • We do not promise coverage. Guard Cover is available only where a Response Partner operates, and availability can change. The MyGuardz App shows what is available at your location at the time, and you cannot buy Guard Cover for a location we do not cover.

  • A Guard is not a police officer. Guards have no powers beyond those of any other person and will not put themselves at risk. Where an incident requires the emergency services, they will call them, and so should you.

  • Things outside anyone's control. Fire, flood, severe weather, civil disorder, terrorism, epidemic, failure of the mobile or electricity networks, industrial action and similar events can delay or prevent a Response. Neither we nor the Response Partner are responsible for a failure caused by something of that kind.

9.4 Your contract for Guard Cover is with us
When you buy Guard Cover, you buy it from us. We perform it through an independent, licensed Response Partner that we have engaged for your area, and we are responsible to you for supplying the service we have sold you.
We do not employ the Guards and we do not operate the Control Room. We take reasonable care in selecting Response Partners, we require them to be appropriately licensed, and we require them to comply with the law and the codes of practice that apply to them.
The Response Partner's own Service Terms are shown to you in the MyGuardz App before you first switch Guard Cover on in an area. They explain how that Response Partner works and what conditions apply to an Call-Out. They do not replace these Terms, and where they conflict with these Terms, these Terms govern your contract with us.
Nothing in this section affects your rights under Section 15.

9.5 Who the Response Partner is, and how they are licensed
The MyGuardz App identifies the Response Partner covering your area, and gives you their company details and an address for complaints, before you buy Guard Cover.
In the United Kingdom, Guards providing an Call-Out hold individual licences issued by the Security Industry Authority. Our Response Partner is contractually required to ensure that every Guard dispatched holds a valid licence and that its services comply with applicable law, codes of practice and Approved Contractor Scheme requirements.

9.6 Where Guard Cover is available
Guard Cover is offered only in areas a Response Partner covers. The MyGuardz App will not let you buy Guard Cover for a location outside those areas. Coverage can change, and cover you have already bought applies only to the area it was bought for.

9.7 What is shared with the Response Partner
When Guard Cover is active and an Alarm is forwarded to a Response Partner, your name, contact number, live location or Home address, and any information you have chosen to include with the Alarm will be shared with the Response Partner for the purpose of responding to the Alarm. See the Privacy Policy.

9.8 Following a Call-Out, and standing one down

When a Call-Out is made, a tracking link appears in the Alarm Chat. You, and any member of your Circle who has joined that Alarm Chat, can use it to follow the Guard's progress.

There are two ways to stand a Call-Out down, and either works until the Guard reaches you:

  • On the call. Tell the Control Room you are safe and give them the last four digits of your mobile number. That is how they confirm it is really you.

  • In the Alarm Chat. Open the tracking link and confirm with the same four digits.

Standing a Call-Out down stops the Guard travelling to you. Once a Guard has been dispatched, the Call-Out has been made - it is not refundable, whether or not you stand it down before they arrive. See §10.6. If you stand one down by mistake, or the situation changes, raise a new Alarm straight away.

Those four digits are how anyone standing a Call-Out down is identified. So anyone on the call with the Control Room, or in your Alarm Chat, who knows the last four digits of your number can cancel the Guard. Members of your Circle already have your number. In practice, any Circle member who has joined your Alarm Chat can call off a Guard who is on the way to you. Choose your Circle accordingly. If a Call-Out is stood down, we tell you who did it.

10. PRICES, PAYMENT AND REFUNDS

10.1 What is free
The MyGuardz App is free to download and use. Stay With Me Timers, your Circle, Alarms, the Alarm Chat, Live Location during an Alarm, Homes, Households and Connected Devices cost nothing. There is no subscription.

10.2 What is paid

Guard Cover is the only paid part of MyGuardz, and it is charged on a pay-per-use basis. You pay when you switch it on, and the purchase does not renew.

  • On the Go. Covers one trip. It starts when you switch it on and runs until the trip is resolved - by your check-in, or by an Alarm being raised and then closed. A trip can run up to the maximum Timer length shown in the App; if it reaches that point without a check-in, an Alarm is raised.

  • Home. Covers one Home for the period shown in the App. An Alarm does not end it.

You are told what is included before you pay. Prices, cover periods and what each purchase includes are shown in the MyGuardz App before you confirm. Prices include VAT and are the total you pay for that purchase.

The price shown to you when you confirm is the price of that purchase, and we cannot change it afterwards. Prices, cover periods and what is included may change for future purchases, and they vary by area and by time of day. What applies to any purchase is what the App showed you at the moment you made it.

How many Call-Outs your purchase includes is shown in the App before you confirm.

Some situations can cost more than the purchase price. If more is needed than your purchase includes - for example a further Call-Out for the same Alarm, or a Guard having to remain at the scene - a further charge may apply. Where that is possible, the App shows you the charge before you switch Guard Cover on, and you are told again before the further work is done. We will not charge you for anything that was not shown to you and agreed by you.

10.3 How payment works
You purchase Guard Cover through the MyGuardz app. We will issue an invoice to the email address associated with your Account.
Payments are processed securely by Stripe. MyGuardz does not store or have access to your full credit card details. Card payment information is collected and processed by Stripe in accordance with Stripe's own terms and privacy practices. Our Privacy Policy explains what information is shared with Stripe and why.
Payment is taken when you switch Guard Cover on.

10.4 Failed payments
If your payment method expires, is declined or cannot be charged, we may attempt any other payment method saved on your Account. We will tell you if we cannot collect, and we may suspend Guard Cover until the outstanding amount is paid. Guard Cover that has not been paid for is not active.

10.5 False Alarms
If a Guard is dispatched in response to an Alarm, that Call-Out counts whether or not the Alarm turned out to be genuine - including an Alarm caused by a Timer expiring because your phone lost power or lost signal, or by a Connected Device misfiring. It uses the Call-Out included in your Guard Cover, and where a further Call-Out is chargeable, the charge applies.
Because the Stay With Me Timer runs on our servers, a flat battery does not prevent an Alarm - it prevents you cancelling one.

10.6 Cancellation and refunds
What you are buying. Guard Cover provides access to monitoring by the Response Partner's Control Room and, where applicable, the dispatch of a Guard in response to an Alarm. The service begins immediately when you activate Guard Cover in the MyGuardz App and remains active for the selected coverage period.
Your statutory right to cancel. If you are a consumer in the UK or the EU, you normally have 14 days to cancel a contract for services bought at a distance. By switching Guard Cover on you ask us to begin the service immediately, and you acknowledge that once a Response has been provided you lose the right to cancel that Response. Where the service has not yet begun, your cancellation right is unaffected and you can cancel in the MyGuardz App.
Switching cover off. You can switch Guard Cover off at any time in the MyGuardz App. This ends your cover for the remainder of the selected period but does not entitle you to a refund for Guard Cover already activated, except where required by applicable law.
Call-Outs. Once a Call-Out has been made it has been performed and cannot be cancelled or refunded, whether or not the Alarm turned out to be genuine.
Complaints and refunds. If you are dissatisfied with a Guard's conduct or with the handling of an Alarm, tell us at team@myguardz.com. We will investigate, take it up with the Response Partner, and tell you the outcome. Repeated complaints affect whether we continue to work with that Partner.
You, and not we, are responsible for any charge made by a third party in connection with an Alarm - for example a false-alarm charge levied by a police force, an ambulance or other emergency-service cost where one applies, or the cost of repairing damage caused in gaining access to a property during a Response you asked for.

11. YOUR CONTENT

We retain Alarm Chat records for a limited period after an Alarm is closed for evidential purposes and to support the resolution of complaints or disputes. After that period, the records are permanently deleted unless continued retention is necessary for the establishment, exercise, or defence of legal claims, compliance with legal obligations, or requests from competent authorities.

We may access, scan or retain a communication for longer where it is necessary to investigate a report of abuse, to prevent fraud or a threat to safety, to comply with a legal obligation, or to provide support you have asked for. We may block or review content we reasonably believe is malicious, is spam, or presents a risk to you or another User.

We have no access to anything you say outside MyGuardz - a phone call, a text message or another app.

12. AVAILABILITY AND CHANGES TO THE SERVICE

We will use reasonable skill and care to keep MyGuardz available, but we do not guarantee uninterrupted or error-free operation. We may suspend the service for maintenance, and we will give notice where it is reasonably practical to do so.

We may add, change, or withdraw features. Where a change materially reduces a feature you rely on, we will give you reasonable notice.

Features identified as beta or preview are provided as-is and may be changed or removed without notice.

13. DISCLAIMERS

To the fullest extent permitted by law, and subject always to Sections 9.4, 14.1 and 15:

  • We make no representation, warranty or guarantee as to the safety, reliability, timeliness, quality or suitability of any other User, of any Circle member, or of any Connected Device or third-party platform.

  • We do not guarantee that an Alarm will be raised, delivered, seen, opened or acted upon by the people you have chosen.

  • We do not guarantee that a Guard will be dispatched, or that a Response Partner will have capacity at a given moment.

  • We do not verify the identity, reputation, conduct, or background of Users, and we do not endorse them. You are solely responsible for deciding whom to trust with your location and your safety.

  • Except as expressly stated, MyGuardz is provided "as is" and "as available".

Nothing in this Section reduces our responsibility under Section 9.4 for supplying Guard Cover with reasonable care and skill.

14. LIMITATION OF LIABILITY

14.1 What we never limit
Nothing in these Terms limits or excludes our liability for:

  • death or personal injury caused by our negligence;

  • fraud or fraudulent misrepresentation;

  • any liability that cannot lawfully be limited or excluded, including your non-excludable rights as a consumer and our obligation to supply a service with reasonable care and skill.

14.2 What we do limit
Subject to §14.1, and to the fullest extent permitted by law:

  • We are not liable for indirect, incidental, special, punitive or consequential loss, including loss of profit, loss of data, or loss arising from your inability to access MyGuardz.

  • We are not liable for loss or damage arising from: the failure of a Circle member to respond; the acts or omissions of any other User; the failure or malfunction of a Connected Device or third-party platform; the failure of your device, its battery, its operating system, its permissions, or your network; or any Alarm that was not delivered, or delivered late, for a reason outside our reasonable control.

  • Subject to §14.1, our total aggregate liability arising out of or in connection with these Terms is limited to the total amount you paid us for Guard Cover in the 12 months before the event giving rise to the claim.

14.3 Disputes with other Users
To the fullest extent permitted by law, you release us from claims arising out of a dispute between you and another User.

15. CONSUMER RIGHTS

If you are a consumer, you have legal rights that these Terms do not affect. In the UK these include your rights under the Consumer Rights Act 2015 to services carried out with reasonable care and skill, and your rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. In the EU, your mandatory consumer protections in your country of residence cannot be waived.

Where any clause in these Terms conflicts with a right you cannot waive, that right prevails.

16. INDEMNITY

You agree to indemnify us and our directors, employees and agents against claims, losses and reasonable costs arising from: your use of MyGuardz through your Account; your breach of these Terms; your User Content; your addition of another person's data without their consent; or your infringement of the rights of another User or any third party. This does not apply to the extent the claim arises from our own breach or negligence.

17. INTELLECTUAL PROPERTY

All intellectual property rights in MyGuardz - including the software, the MyGuardz name, the shield mark, the interface and all associated documentation - remain ours or our licensors'. These Terms grant you a limited, personal, revocable, non-transferable licence to use the MyGuardz App on devices you control. Nothing else is granted.

You must not copy, modify, distribute, sell, lease or reverse-engineer any part of MyGuardz, except to the extent that restriction is prohibited by law.

18. TERM, SUSPENSION AND TERMINATION

These Terms apply from the moment you create an Account until it is closed.

You may stop using MyGuardz at any time and ask us to close your Account. Closing your Account ends all Timers, removes you from Circles you belong to, and ends any active Guard Cover. Tell the people who rely on you - a Household or a Circle member who expects you to be there will no longer receive anything.

We may suspend or close your Account if you materially breach these Terms, if we are required to by law, or if we reasonably believe your use presents a risk to another person. Except where it would be unlawful or unsafe to do so, we will tell you why and give you a chance to respond.

Outstanding payments, and Sections 11, 13, 14, 16, 17 and 20, survive termination.

19. COMPLAINTS

Tell us at team@myguardz.com. We will review your complaint and respond as soon as reasonably possible.

If you are a consumer in the EU you may use the European Commission's online dispute resolution platform at ec.europa.eu/odr.

20. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of the Republic of Croatia. Disputes will be resolved by the competent court in Zagreb.

If you are a consumer, this does not deprive you of the protection of the mandatory laws of your country of residence, and you may bring proceedings in the courts of your own country.

21. CHANGES TO THESE TERMS

We may change these Terms. We will publish the amended version at https://www.myguardz.com/terms-of-service and in the MyGuardz App, and will notify you at least 15 days before a material change takes effect. Continuing to use MyGuardz after that date means you accept the change. If you do not accept it, close your Account before it takes effect.

22. GENERAL

You may not assign these Terms without our written consent. We may assign them to an affiliate or to a successor of our business, provided your rights are not reduced.

Nothing in these Terms creates a partnership, joint venture, employment or agency relationship between you and us.

If we do not enforce a right, we do not waive it. If any provision is held invalid, the rest continues in force.

These Terms, with the Privacy Policy, are the entire agreement between us.
